BagsAway Terms and Conditions of Use

  1. General
    1. These Terms and Conditions (the Terms) govern your use of our services and the website located at www.bagsaway.com (the website) and forms a binding contractual agreement between you, the user of our services and the website (you or your) and us, BagsAway, the provider of the services and the owner and operator of the website and any associated mobile phone application (BagsAway, us, our or we).

    3. By using our services and/or the website you acknowledge and agree that you are at least 18 years of age and that you understand these Terms and agree to be bound by them. If you are under 18 years or age or do not agree to these Terms, please do not use our services or the website.
    4. BagsAway provides luggage storage services (the services). Customers may register or book to securely store their luggage at one of our verified local storage partners. You book on the website , drop your luggage off at our partner location or have it delivered and then arrange to collect your luggage at your convenience.
    5. Information on the website is general information only. BagsAway and its owners, agents or employees do not accept and are by these Terms released by you of, any liability to you arising (whether directly or indirectly) out of the information provided on the website or anyone else through the website or any errors in, or omissions from information on the website.
    6. Any commercial use of the website by you requires the prior written approval of BagsAway.
    7. These Terms must be read in conjunction with any other notices, disclaimers and policies displayed elsewhere on the website or provided by us to you.
    8. BagsAway reserves the right to change these Terms, the website or content contained with the website at any time with or without any notice to you and without giving any explanation for such change.
    9. BagsAway does not provide any professional advice and gives no warranty, guarantee or representation about the accuracy, reliability or timeliness or otherwise, of the information contained on the website and/or linked to any user of the website.
    10. You will at all times indemnify and keep indemnified BagsAway and its respective officers, employees and agents (referred to as those indemnified) from and against any loss (including reasonable legal costs and expenses) or liability incurred by any of those indemnified arising from any claim, demand, suit, action or proceeding by any person against any of those indemnified where such loss or liability arose out of, in connection with or in respect of any breach of these Terms by you.
    11. The website may contain links to other sites. We cannot control any information on these sites and are not responsible for any information contained on those sites or the privacy practices or terms of use of those sites.
    12. Any failure on our part to enforce any provision of these Terms is our right and shall not constitute a waiver of our right to enforce that or any other provision.
    13. Should any provision of these Terms be unlawful, void, or otherwise legally unenforceable, the rest of these Terms shall remain enforce as though the unenforceable provision had not been a part of these Terms.

  2. Users of our Services
    1. You acknowledge that the BagsAway website is a platform that allows you to book or reserve luggage storage with one of our verified local storage partners. Reservations for use of our services are made via the website and you will receive an email confirming your bookings once it is complete.
    2. All reservations or bookings must be paid for at the time of reservation by credit card/debit card or via our payment service providers or as otherwise stated on the website. You must fill out all relevant particulars listed on the booking form on the website when you make a booking or reservation.
    3. By using our services you acknowledge and agree to the following:
      1. We can not fully guarantee the security of your luggage and it may be subject to risk of loss, damage or theft;
      2. All luggage items are insured up to $1,200 to cover possible loss, damage and theft;
      3. Each item of luggage is secured with a one-time security seal & tags
      4. Our customer support agents are available to assist on the online live-chat, email & phone; and
      5. Our services are absolutely cash-free and conducted electronically.
    4. Each luggage item is individually secured with a tamper-proof seal with a unique serial number assuring your belongings are never accessed. Upon booking your luggage storage you will receive an automated receipt via email with a system generated booking number. A branded BagsAway tag with the booking number will be attached to each item as an additional security measure to ensure the correct items are returned to you. You will be required to present the email receipt upon picking up your items at the partner location. Our storage partners are carefully instructed to store all luggage items away from public access so leave your luggage and your concerns behind!
    5. You acknowledge that any description of the services listed on the website may be listed in error and BagsAway does not warrant that any information listed in the website is accurate or error free.
    6. BagsAway and its authorised representatives may gather and process any information which you provide when accessing the website which may include personal information. Please see our Privacy Policy for further details on how we manage your personal information.
    7. You acknowledge that BagsAway may use any information provided by you on the website to engage in direct marketing to you in any medium unless you do not authorise us to do so.
  3. Luggage Storage
    1. We accept a wide variety of luggage including travel luggage/bags, strollers, sports equipment (ski, golf, snowboard, skates, etc), bicycles, boxes, keys, and coats.
    2. We do not accept the following:
      1. Single pieces of luggage weighing over 30kg;
      2. Luggage with a height, width or depth of over 2.5 metre;
      3. Metal trunks;
      4. Handbags (and similar items) that contain important personal effects (keys, wallets, credit cards, cash, ID, etc.);
      5. Any item worth more than$1,200 including watches, luxury luggage and bags, computers, tablets and similar items, musical instruments, clocks, porcelain, earthenware, ornaments and decorative objects, rugs, paintings, tapestries, furs, books, silver-plated cutlery, collections, etc;
      6. Any fragile items: crockery, porcelain, earthenware, etc;
      7. Perishable food items;
      8. Medication,
      9. Cigarettes, tobacco and tobacco products;
      10. Liquids, wines and spirits;
      11. Chemical, toxic or dangerous products;
      12. Mouldy, polluted or contaminated items;
      13. Weapons, ammunition, explosives, combustibles and fireworks;
      14. Radioactive or dangerous materials,
      15. Combustible liquids (e.g. LPG, home heating oil, heavy oil and similar products);
      16. Combustible gases (such as acetylene, methane, butane and propane, hydrogen, etc.);
      17. Flammable liquids;
      18. Illegal substances;
      19. Living things (animals, plants or other);
      20. Waste;
      21. Stolen or illegally held goods;
      22. Goods stored for commercial purposes;
      23. Jewellery, metals or precious gems, natural pearls, works of art;
      24. ID card, passport, driving licence, property deeds, and other official documents;
      25. shares, securities, cash, bank cards, coins; and
      26. any other form of payment.
    3. You will find particulars on our website which indicates the maximum item capacity available at any location. Unlike locker facilities our partner spaces are flexible to accept all luggage types, shapes and sizes.
    4. You acknowledge that we have the right to refuse to store any item at our absolute discretion and without providing a reason to you for such refusal. Where you have made a booking and we reject your item or items, you will be provided with a full refund.
    5. You acknowledge that BagsAway and any verified local storage partners cannot guarantee the safety or security of any item you store with us and you do so at risk of loss, damage or theft.
    6. You acknowledge that our insurance coverage covers your booking for any damage, loss or theft for $1,200 per luggage item up to a maximum of $2,500 per order. To ensure the validity of the insurance coverage you must ensure to book your storage online via the website. All transactions are cashless, never pay cash in person with a storage partner.
    7. For purposes of insurance coverage and security the same individual must drop off and pick-up the luggage items stored with our partners. You are required to show proof of ID when picking-up and dropping-off your luggage
    8. You acknowledge that you are responsible of ensuring to pick-up your items during the storage location hours of operation indicated on our website. If you have an issue or are running late to pick up your items, please refer to the booking confirmation email you received to contact the partner location on the number listed. If you are having trouble reaching the partner, please call us 1-844-647-2247 8am-8pm EST or contact us on the live chat on the website.
  4. Users of the Website
    1. The Website is accessible to you via internet on a fixed or mobile device with a web browser.
    2. Some of the website functionality can be used for free and without registration, whereas other areas require registration. In order to access the full range of our services you acknowledge that you must register on the website and create an account with us.
    3. Only those who declare themselves to be of legal age, with the legal capacity of entering into a contract and able to satisfy BagsAway’s requirements may create an account.
    4. In order to create an account, you must complete the online form on the website with the following items: name, surname, email address, country of residence, payment particulars and desired password. An email address confirmation will then be sent. You warrant to us that all information you provide is accurate.
    5. Your username and password are strictly personal and confidential and are stored encrypted in our database. BagsAway will not be held responsible for logins by third parties or any misuse of your account.
  5. User Comments and Social Media
    1. Users with a BagsAway account may provide comments and feedback on the services, including comments and feedback on events or experiences listed on the website. BagsAway may also operate social media pages such as Facebook.
    2. You as a user of the services warrant to BagsAway that any postings and comments made by you will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the website. You agree that you may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. BagsAway take no responsibility and assume no liability for any comments posted by you or any third-party.
    3. If you provide any postings on the website or any social media page controlled by BagsAway such as reviews or other statements or opinions you acknowledge that that we may, but have no obligation to, monitor, edit or remove such content that we determine in our absolute discretion are unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms.
  6. Pricing & Payment
    1. BagsAway charges an hourly fee with a minimum and maximum number of hours per day. A small fee per order and overnight storage fees may also be charged.
    2. All pricing information is available on the website.
    3. All payments must be made through the website. Storage bookings paid in cash or directly to the partner will not be covered by the BagsAway insurance policy and may put your personal belongings at risk.
  7. Cancellation Policy
    1. You may cancel your luggage storage booking any-time before your drop off your luggage with us. You will not incur any penalties or be charged any fees. In the event you choose to cancel your booking your card with be refunded the total booking amount.
    2. If we reject any luggage item, you may receive a refund for that booking.
  8. Customer Support & Complaints Policy
    1. You can view all your booking history under your profile upon signing up and logging into your BagsAway profile using the login credentials you created when signing up on our website.

    3. BagsAway will attempt to resolve any customer complaints and answer any questions within 2 business days of the first contact made by a customer by email to [email protected]
  9. Governing Terms
    1. You agree that these Terms, and any purchases made by you via the website or use of our services in any other manner, shall be governed solely by the laws applicable to the province of Ontario, Canada.
    2. For the avoidance of doubt, you agree to the jurisdiction of the courts of Toronto, Ontario, Canada to determine any dispute arising out of these Terms, your use of the website or your use of our services.
  10. Disclaimer of Liabilities
    1. You acknowledge that BagsAway does not warrant, guarantee or make any representation that:
      1. the website is free of software viruses;
      2. the functions contained in any software hosted on the website will operate uninterrupted or error-free; and
      3. errors and defects found on the website will be corrected.
    2. You acknowledge that BagsAway is not liable to you for:
      1. errors or omissions in the website;
      2. delays to, interruptions of or cessation of the website; and
      3. offensive or illegal conduct of any user of the website or our services, whether caused through our negligence, our employees or independent contractors, or through any other cause.
    3. You agree to accept the full cost of any necessary repair, correction and maintenance of any of your computer software or hardware, which may be necessary as a consequence of you accessing the website.
    4. You agree to indemnify and hold harmless BagsAway and all its related parties, associates and authorised representatives from all claims, demands, liabilities, losses, damages and expenses (including without limitation reasonable legal fees and expenses), arising from or in connection with the use of the website or our services.
  11. Intellectual Property
    1. The brand names, slogans, trademarks, service marks, designs, and logos used on the website, including without limitation the BagsAway business name and logo, are the trademarks of BagsAway.
    2. You further agree not to use any domain name, trademark, trade name, service mark, logo, or other materials confusingly similar to the trademarks without our prior written consent.
    3. All information and materials published, transmitted, or otherwise available on the website or through the provision of our services are protected by copyright or trademarked (as applicable), and owned or controlled by BagsAway, its licensors, or affiliated companies.
    4. You shall abide by all copyright and trademark notices, limitations, and restrictions applicable to BagsAway. Without limiting the foregoing, no content owned by us may be copied, reproduced, published, reused, uploaded, downloaded, posted, or transmitted, other than through the website or the provision of our services in accordance with its intended use.
  12. Force Majeure

You agree not to hold us liable for any disruption of our service or failure to deliver our services for any reason beyond our control, including, but not limited to, natural disasters, war, insurrection, terrorism, riots, criminal acts, labor shortages, labor strikes (both lawful and unlawful), infrastructure disruption, communication failure, or any other circumstance that may be beyond our control.
